KIDS TROVE TOY RENTAL AGREEMENT AND LIABILITY WAIVER

This Toy Rental Agreement (“Agreement”) is made effective as of the time of reservation (“Effective Date”), by and between Kids Trove (“Lessor”) and the customer (“Borrower”).

1. DISCLAIMER

This Agreement outlines the terms and conditions under which the Borrower will rent toys and equipment from Kids Trove. By completing a reservation, the Borrower agrees to all terms and conditions contained herein.

2. EXPRESS ASSUMPTION OF RISK

Borrower acknowledges that they are renting and using the equipment at their own risk. Borrower voluntarily assumes all risks of injury, illness, damage, or loss that might result from the use of rented toys and equipment, including risks arising from the negligence of Kids Trove.

3. WAIVER/RELEASE OF LIABILITY

By executing this Agreement, Borrower agrees that Kids Trove shall not be liable for any damages arising from personal injuries sustained by Borrower or anyone under the Borrower’s supervision while using the rented toys/equipment. Borrower assumes full responsibility for such injuries or damages and agrees that Kids Trove shall not be liable for loss or theft of personal property.

4. RENTAL TERMS AND PAYMENT

4.1 Rental Periods

  • Standard rentals available in 1-week, 2-week, and 3-week, 4-week intervals.
  • Party items restricted to 1-week rentals only.
  • All rentals must be returned by 6:00 PM on the due date.

4.2 Payment Authorization

  • Full payment required at time of booking.
  • Valid credit card must be maintained on file.
  • Borrower authorizes Kids Trove to charge their card for:
    • Initial rental fees.
    • Late return fees.
    • Damage charges.
    • Replacement costs for unreturned items.

5. DAMAGES AND LATE RETURNS

5.1 Late Returns

 

  • Items not returned after rental period will be charged at full retail price.
  • Late return fees will be charged to card on file.

5.2 Damage Policy

  • 50% of retail price charged for damaged items.
  • Full retail price charged for unreturned items.
  • Normal wear and tear excluded.
  • All damage charges will be processed on card on file.
  • Borrower will be notified before processing damage charges.

6. BORROWER RESPONSIBILITIES

6.1 Care and Use

  • Follow age recommendations and safety guidelines.
  • Supervise children during toy use.
  • Return items clean and in original packaging.
  • Report any damage immediately.
  • Return all components and accessories.

6.2 Cleaning and Sanitization

  • Maintain reasonable cleanliness during rental period.
  • Return items in sanitary condition.
  • Additional cleaning fees may apply if items returned dirty.

7. SECURITY AND PAYMENT

7.1 Credit Card Authorization

Kids Trove maintains credit card information on file for:

  • Security deposit holds.
  • Damage charges.
  • Late return fees.
  • Replacement costs.
  • Additional cleaning fees if required.

7.2 Charges and Notifications

  • Borrower will be notified of any additional charges.
  • Charges will be processed after notification.
  • Itemized receipt provided for all charges.

8. DISPUTES

If a dispute arises regarding this Agreement, Borrower agrees to first attempt resolution directly with Kids Trove through good faith negotiation. If unable to resolve, parties agree to mediation before pursuing legal action.

9. SEVERABILITY

If any provision of this Agreement is held invalid or unenforceable, such provision shall be struck while the remainder of the Agreement remains in effect.
